1. Acceptance of Terms
By accessing or using Birdog (“Service”), operated by Birdog LLC (“Company,” “we,” “us”), you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and legally capable of entering a binding contract.
2. Description of Service
Birdog provides scheduling, communication, and workflow automation tools for construction project management. Birdog includes AI-assisted text messaging and automated phone calls to project participants, and an AI-powered in-app help assistant that answers questions about how the Service works.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
3. User Accounts
You are responsible for maintaining confidentiality of login credentials
You are responsible for all activity under your account
You agree to provide accurate and complete information
We may suspend or terminate accounts for violations
4. Subscription & Payments
Birdog operates on a subscription basis (monthly/annual)
Payments are billed through:
Apple In-App Purchases (if purchased via iOS), or
Direct billing (web platform)
Subscriptions are billed monthly per project license. Purchases made on the web or on Android are processed by Stripe; purchases made in the iOS app are processed by Apple as in-app purchases and are subject to Apple's terms. Prices may differ between purchase channels, and the price shown at the time of purchase is the price you will be charged. Subscriptions renew automatically each month until cancelled.

5. Free Trials
New customers may be offered a 30-day free trial that includes one project license. A valid payment method is required to start a trial. At the end of the trial, your subscription converts automatically to a paid monthly subscription at the price shown when you started the trial, unless you cancel before the trial ends. You can cancel at any time from your Profile in the app, from the billing portal (web and Android), or through your App Store subscription settings (iOS); a cancelled trial ends on its scheduled end date and you will not be charged.
Adding project licenses during a trial ends the trial immediately and starts your paid subscription that day, at the price shown before you confirm. Each customer is eligible for one free trial. On iOS, the free trial is provided as an introductory offer and is subject to Apple's eligibility rules, which allow one introductory offer per Apple ID. Automated reminders for a project may stop shortly after a trial ends without a paid subscription.
6. Acceptable Use
You agree NOT to:
Use Birdog for illegal purposes
Upload harmful, abusive, or misleading content
Attempt to reverse-engineer or disrupt the Service
Interfere with other users or system performance
7. User-Generated Content
You retain ownership of your data (project schedules, communications, etc.).
However, you grant Birdog a license to:
Host
Store
Process
Display
your content solely to operate and improve the Service.
8. Data & Privacy
Your use of the Service is also governed by our Privacy Policy.
We collect and process data necessary to:
Provide scheduling automation
Send notifications and confirmations
Improve system performance
9. Third-Party Services
Birdog may integrate with third-party tools (e.g., SMS providers, email services).
We are not responsible for:
Third-party outages
External service failures
10. Service Availability
We do not guarantee uninterrupted or error-free service.
Construction scheduling is dynamic, and Birdog is a tool—not a guarantee of project outcomes.
11. Disclaimer of Warranties
The Service is provided “AS IS” and “AS AVAILABLE.”
We disclaim all warranties, including:
Fitness for a particular purpose
Reliability of scheduling outcomes
Accuracy of automated communications
Accuracy or completeness of answers from the in-app help assistant, which are generated automatically and are not professional, legal or financial advice
12. Limitation of Liability
To the fullest extent permitted by law:
Birdog shall not be liable for:
Lost profits
Project delays
Contractual disputes between users and subcontractors
Total liability is limited to the amount paid by you in the last 12 months.
13. Indemnification
You agree to indemnify and hold Birdog harmless from claims arising from:
Your use of the Service
Your violation of these Terms
Disputes with subcontractors or third parties
14. Termination
We may suspend or terminate your account at any time if:
You violate these Terms
You misuse the platform
You may cancel your subscription at any time.
15. Governing Law
These Terms are governed by the laws of the State of Utah, United States.
16. Changes to Terms
We may update these Terms at any time. Continued use constitutes acceptance of the updated Terms.

Birdog (“Birdog,” “we,” “us,” or “our”) operates a construction scheduling and coordination platform designed to facilitate communication between project managers and subcontractors. This Privacy Policy explains how we collect, use, and protect personal information.
1. Information We Collect
We collect information that users provide directly, including but not limited to:
Name
Company name
Email address
Mobile phone number
The content of text messages and phone calls exchanged with our automated scheduling assistant, including call transcripts and the scheduling outcomes derived from them.
Questions you type into the in-app Birdog Assistant (help chat), your ratings of its answers, and any bug reports or support requests you submit through the app, including the description you provide and basic technical details about your device (platform, device model, operating system version, app version and the screen you were on).We may also collect limited technical information such as IP address, device type, and usage data to support and improve the platform.
2. How We Use Information
We use the information we collect to:
Provide and operate the Birdog platform
Coordinate construction project schedules
Send notifications, reminders, confirmations, and project updates
Provide customer support
Improve platform functionality and reliability
We use artificial-intelligence services to draft scheduling messages from your project data, to interpret replies from project participants, to conduct automated phone calls about scheduled work, and to power the Birdog Assistant, an in-app help chat that answers questions about how Birdog works. AI is used only for project-coordination and product-help tasks; it does not make binding decisions — schedule changes proposed from a reply or call are reviewed and approved by the contractor in the app, and the Birdog Assistant cannot view or change your projects, schedules or account. Answers from the Birdog Assistant are generated automatically and may be inaccurate; they are not professional advice.

Personal information is used solely for legitimate business and service-related purposes.
3. SMS Communications
Birdog uses SMS text messaging to communicate with subcontractors and project participants regarding active construction projects. Messages may include scheduling notifications, reminders, confirmations, updates, and requests for information related to project coordination.
Messages may be generated by an AI assistant and may be conversational; replies are processed by AI to understand scheduling responses; messages may be sent in Spanish where a participant prefers it.
Users provide consent to receive SMS messages by opting in during project onboarding or by replying YES to an initial opt-in message that clearly identifies Birdog as the sender and explains the purpose of the messages.
Message frequency varies based on project activity.
Users may opt out of SMS messages at any time by replying STOP. For assistance, users may reply HELP.
Birdog does not send marketing or promotional text messages.
4. Automated Phone Calls
Where a participant has not responded to text reminders, or a text conversation could not resolve a scheduling question, Birdog may place an automated phone call from +14356667217. Calls are conducted by an AI voice assistant, are transcribed, and a transcript and summary are stored with the project. Call audio is processed by our voice provider and is not stored by Birdog. Participants may end automated calls at any time by asking not to be called again, or by replying STOP to any text message.
5. In-App Birdog Assistant and Support
The Birdog Assistant is an optional help chat in the app's Help Center. When you ask it a question, the text you type is sent to our AI provider along with a small set of account facts needed to give an accurate answer: your platform (iOS, Android or web), app version, subscription status (for example, trial or active), number of project licenses, and trial end date. Your name, contact details, project schedules and text-message history are not sent to the assistant. The assistant answers only from a fixed knowledge base about how Birdog works and cannot take actions on your account.
Your questions and the assistant's answers are stored so you can continue a conversation and so we can improve the knowledge base. You can rate any answer, and you can delete your chat history at any time from the Help Center. Conversations that have been inactive for 90 days are deleted automatically.
If you submit a bug report or ask to talk to a person, your request is stored and emailed to Birdog support together with the details you provide, the technical details listed in Section 1, and the most recent turns of your help chat so that we can understand the context. Support requests are kept as service records for as long as your account is active.
The onboarding walkthrough creates a sample project and, if you choose to run it, sends one or two demonstration text messages to the mobile number on your own account so you can see how reminders work. These messages go only to you, and the sample project is deleted when you finish the walkthrough or create your first real project.
6. Data Sharing
Birdog does not sell, rent, or share personal information, including mobile phone numbers, with third parties for marketing or promotional purposes.
We share personal information only with service providers that process it on our behalf to operate Birdog. Each provider is limited to the purpose listed and may not use the information for its own purposes:
Twilio — delivery of text messages and telephone calls. Receives phone numbers and message content.
Anthropic — artificial-intelligence processing used to draft scheduling messages, interpret replies, and answer questions in the in-app Birdog Assistant. For scheduling messages, receives message content and the project schedule information needed to compose or understand a message. For the Birdog Assistant, receives the questions you type and the account facts listed in Section 5 (platform, app version, subscription status, license count and trial end date). Anthropic does not use data sent through its API to train its models.
ElevenLabs — automated voice calls. Receives the phone number being called, the scheduling information discussed on the call, and the call audio, which it transcribes for us. Birdog stores the transcript and outcome, not the audio.
Stripe — payment processing and subscription billing for purchases made on the web and on Android. Receives billing details; Birdog never stores full card numbers.
Apple — payment processing for in-app purchases on iOS, under Apple's terms.
RevenueCat — management of in-app subscription status.
Amazon Web Services — hosting, database storage, and transactional email.
Expo — delivery of push notifications to your device.
7. Data Security
We take reasonable administrative, technical, and physical measures to protect personal information from unauthorized access, disclosure, or misuse. However, no system can be guaranteed to be completely secure.
8. Data Retention
We retain personal information only for as long as necessary to provide services, comply with legal obligations, resolve disputes, and enforce agreements.
Message history and call transcripts are retained for as long as the associated project and account are active. When you delete your account, your personal information is deleted or anonymized, and messages and transcripts are no longer associated with you.
Birdog Assistant conversations are deleted after 90 days of inactivity, or sooner if you delete them from the Help Center. Bug reports and support requests are retained as service records; when you delete your account, your help-chat history is deleted and the personal information in your support requests is redacted
9. Your Rights and Choices
You may request access to, correction of, or deletion of your personal information by contacting us using the information below, subject to applicable legal requirements.
You may opt out of SMS communications at any time by replying STOP.
To report an inaccurate, inappropriate or offensive automated message or call, contact info@birdogapp.com with the message date and project; we review every report.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. Updates will be posted on this page with a revised “Last Updated” date.
